CBI & ED Under the Scanner: Independent Investigation or Political Pressure?

India’s powerful investigative agencies are once again facing uncomfortable questions after the Supreme Court criticised the pace and conduct of the CBI and Enforcement Directorate (ED) in the Leaps and Bounds investigation linked to TMC MP Abhishek Banerjee. The Court questioned why the agencies had allegedly been slow despite earlier judicial concerns and said its role was to ensure a fair investigation.

But this controversy cuts both ways. The government can legitimately argue that political connections cannot become a shield against investigation. If financial transactions or recruitment-scam allegations require investigation, Opposition leaders and their associates should face the same legal scrutiny as anyone else. Political status cannot mean immunity.

Yet the uncomfortable question remains: why do central agencies so often become the centre of political controversy? Opposition parties have repeatedly accused the government of using CBI and ED selectively against political rivals. In the present case, however, the Supreme Court's criticism is particularly significant because it focused on the agencies' conduct and pace—not simply on the political allegations themselves.

The solution is simple but politically difficult: investigate everyone, but investigate everyone fairly. Neither the BJP-led government nor Opposition parties should be allowed to turn investigative agencies into political weapons—or political shields. If there is evidence, prosecute it; if there isn't, don't manufacture suspicion. The real test of India's democracy isn't whether agencies investigate powerful politicians—it is whether they can do so without fear, favour or political instructions.
